Jordan’s Cookies AI Video Consent Policy

This AI Video Consent Policy explains how Jordan’s Cookies (“we,” “our,” “us”) uses AI technology to create personalized video messages as part of our holiday gifting services. By submitting content for video creation, you acknowledge and agree to this policy.

1. Purpose of Videos

We create custom AI-generated videos that may use your name, likeness, voice, or submitted materials. These videos are embedded in QR codes and included with holiday cookie gifts.

2. AI Technology & Third-Party Providers

To create these videos, Jordan’s Cookies may use third-party AI platforms (including HeyGen) as part of our process. Your content may be processed through their services and subject to their moderation and acceptable use policies.

3. Likeness & Consent

You confirm that you own, or have permission to use, any likeness, voice, image, or content you submit.

If you are submitting content on behalf of another person (“Actor”), you must have their explicit consent.

The Actor may request removal of their likeness at any time by contacting us directly. Jordan’s Cookies will also honor requests made through HeyGen’s moderation team.

4. AI Results Disclaimer

AI-generated content may not perfectly replicate your voice, image, or mannerisms. Results may vary, and minor imperfections are normal. We cannot guarantee an exact likeness or performance.

5. Content Restrictions

You may not submit content that violates our policies or those of our providers (e.g., HeyGen). Prohibited content includes but is not limited to:

-Depicting minors,

-Political or campaign-related content,

-Violence, hate speech, or explicit/sexual content,

-False/misleading information,

-Copyrighted material without authorization,

-Any unlawful or prohibited content.

Violation of these rules may result in your video being blocked or removed by our providers.

6. Moderation & Removal

Jordan’s Cookies and our providers may review and moderate content. If your video is removed for violations, we are not responsible for replacement or refunds.

You, or the Actor you represent, may request removal of your likeness by contacting us at [email protected]. We will also cooperate with removal requests made directly to our provider.

7. Promotional Use

By default, we may use your video, name, and final gift presentation in our marketing, website, or social media. If you prefer not to grant this permission, you must notify us before submitting content.

8. Revocation of Consent

You may withdraw your consent to appear in a video or have your likeness used in marketing at any time before November 15, and we will honor your request in full. After this date, production and fulfillment of holiday orders may be underway, and while we will make reasonable efforts to accommodate requests, we cannot guarantee removal from videos or materials already created or shipped.

9. Storage & Retention

We securely retain videos for as long as reasonably necessary to provide our services, support future holiday orders, and for quality assurance. Unless requested otherwise, we may store your video for up to 3 years, after which it may be permanently deleted. You may also request deletion at any time, and we will honor your request.

10. Liability & Indemnity

You are solely responsible for ensuring you have the necessary rights and permissions for submitted content.

We are not responsible for unauthorized sharing of videos or QR codes by gift recipients.

You agree to indemnify and hold harmless Jordan’s Cookies and its providers against claims arising from your content.

11. Governing Law

This Policy is governed by the laws of Georgia.
